1. Acceptance

These Terms & Conditions (the Terms) govern your access to and use of Advanced Recycling Bin for SharePoint (the Service). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. The Service

The Service lets a SharePoint user connect to one of their SharePoint site collections, search and filter items in its recycling bin, and request restoration of selected items to their original location. The Service relies entirely on the Microsoft SharePoint REST API to perform these operations.

We may add, change, or remove features at any time. Material changes that reduce functionality for paid users will be communicated in advance where practical.

3. Accounts & Billing

To use the Service you must create an account with a valid email address and verify it. You are responsible for keeping your credentials confidential and for all activity on your account.

Paid plans (restore credits and time-based unlimited plans) are described on our pricing page and purchased through our payment processor. Purchases are final and non-refundable except where required by applicable law. Credits do not expire. Time-based plans expire on the date shown at checkout.

4. Third-Party Services & the Microsoft Platform

The Service integrates with Microsoft SharePoint, Microsoft 365, Microsoft Graph, and the Microsoft Identity Platform (collectively, the Microsoft Platform). The Microsoft Platform is operated by Microsoft Corporation and its affiliates, not by us. Its availability, behaviour, and the data it returns are outside our control, including:

  • outages, maintenance windows, and regional availability of SharePoint, Microsoft Graph, or Entra ID;
  • rate-limiting, throttling, and quota enforcement applied to API calls;
  • changes to API contracts, authentication requirements, or permission models;
  • the accuracy or completeness of data returned by SharePoint endpoints, including which items appear in a given recycling bin;
  • whether the Microsoft Platform is able to restore a deleted item to its original location at the time the request is made.

To the fullest extent permitted by law, we disclaim responsibility for any failure, delay, data loss, or inaccurate result that originates from the Microsoft Platform. If SharePoint cannot list an item, cannot restore an item, or returns information that differs from what is visible in the SharePoint web interface, that condition is a property of the Microsoft Platform and not a defect in the Service.

You are responsible for maintaining the SharePoint permissions, licences, and administrator consents required to grant the Service access to your tenant. The Service does not and cannot escalate or grant SharePoint permissions; it only calls SharePoint on your behalf using the credentials you supply during sign-in.

5. Your Responsibilities

You agree that you will not:

  • use the Service to access SharePoint content you are not authorised to access;
  • restore items in a manner that violates your organisation's data-governance or records-retention policies;
  • attempt to reverse engineer, probe, or interfere with the Service beyond what these Terms allow;
  • use the Service to circumvent rate limits or other technical protections of the Microsoft Platform;
  • resell or re-host the Service without our prior written agreement.

6. Data & Privacy

We do not retain the content of your SharePoint site. Our handling of the limited data we do collect is described in our Privacy Policy, which is incorporated into these Terms by reference.

7. Service Availability

We aim to keep the Service available and performant, but we do not warrant that it will be uninterrupted, error-free, or free of vulnerabilities. The Service is provided on an as-is and as-available basis.

8. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising under these Terms is limited to the amounts you actually paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or AUDĀ 100, whichever is greater.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.

9. Termination

You may stop using the Service at any time by disconnecting your SharePoint session and deleting your account. We may suspend or terminate your access if you materially breach these Terms or use the Service in a way that endangers the Service or other users. We will give reasonable notice where practical.

10. Changes to the Terms

We may update these Terms. When we do, we will update the Last updated date above and, for material changes, notify registered users by email. Continued use of the Service after the change takes effect is your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Australia. You and we submit to the exclusive jurisdiction of the courts of that jurisdiction for any dispute arising under or in connection with the Service.
